2. Definitions

Client

The individual, business or organisation purchasing services from Ocean City Web Studios.

Services

Any products or services supplied by Ocean City Web Studios.

Project

Any agreed website, e-commerce website, social media package or other digital service.

Agreement

An agreement is formed once a quotation, proposal, online form, email confirmation or payment has been accepted.

3. Engaging Our Services

A project begins once written confirmation has been received from the Client.

Ocean City Web Studios reserves the right to decline any project without providing a reason.

4. Free Consultations

We offer an initial consultation of up to 20 minutes free of charge.

The consultation is provided for guidance only and does not create a contractual agreement.

Any quotations discussed during the consultation are subject to change following a full review of your requirements.

5. Website Design

Ocean City Web Studios specialises in creating modern, responsive websites tailored to individual businesses.

Our standard website packages include:

• Basic SEO Setup

• Website Hosting

• Ongoing Website Maintenance

6. E-Commerce Websites

E-commerce websites are quoted individually based on project requirements.

Prices may vary depending on:

Third-party charges relating to payment gateways, software subscriptions or integrations remain the responsibility of the Client.

7. Website Hosting & Maintenance

Website hosting and maintenance packages are billed monthly.

Our maintenance packages may include:

• Software Updates

• Security Updates

• Regular Backups

• Technical Support

Monthly subscriptions remain active until cancelled by either party.

If payments become overdue, Ocean City Web Studios reserves the right to suspend hosting services after reasonable notice has been provided.

8. Social Media Management

Social media management packages operate on a monthly basis unless otherwise agreed.

Services may include:

• Content Creation

• Graphic Design

• Scheduled Posting

• Basic Analytics

• Platform Management

Content calendars and publishing schedules may vary depending on the package selected.

9. Client Responsibilities

The Client agrees to:

• Provide accurate information.

• Supply logos, images and written content where required.

• Ensure all supplied materials are owned or appropriately licensed.

• Review submitted work within a reasonable timeframe.

• Notify Ocean City Web Studios of any required amendments promptly.

Delays in providing required information may delay project completion.

10. Revisions

Website packages include reasonable revisions during the design process.

Requests that significantly alter the original project brief or require additional development may incur additional charges.

Any additional work will always be discussed and agreed before being carried out.

11. Payments

Monthly subscriptions are payable in advance.

One-off services must be paid in accordance with the quotation or invoice provided.

Failure to make payment may result in work being paused until outstanding balances have been settled.

12. Website Ownership

Unless otherwise agreed in writing, websites developed under Ocean City Web Studios' monthly website packages remain managed by Ocean City Web Studios whilst hosting and maintenance services remain active.

Where ownership transfer has been agreed, all outstanding invoices must be paid before website files, domains or credentials are transferred.

13. Intellectual Property

All designs, graphics, code and digital assets produced by Ocean City Web Studios remain the intellectual property of Ocean City Web Studios until all agreed payments have been received.

Clients remain the owners of any logos, branding, text and images supplied by them.

14. Portfolio Rights

Unless requested otherwise in writing, Ocean City Web Studios reserves the right to display completed projects within its portfolio, website and social media channels for promotional purposes.

15. Search Engine Optimisation

While we follow recognised SEO best practices, Ocean City Web Studios cannot guarantee:

• Search engine rankings

• Website traffic

• Lead generation

• Sales increases

Search engine algorithms are controlled by third parties and are outside our control.

16. Third-Party Services

Many websites rely on third-party providers including:

• Domain Registrars

• Hosting Providers

• Payment Gateways

• Google Services

• Social Media Platforms

Ocean City Web Studios cannot accept responsibility for outages, policy changes or service interruptions caused by third-party providers.

17. Confidentiality

Both parties agree to treat confidential business information as private and will not disclose such information to third parties without permission unless required by law.

18. Data Protection

Ocean City Web Studios processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Information submitted through our website will only be used for legitimate business purposes.

21. Changes to These Terms

Ocean City Web Studios reserves the right to update these Terms & Conditions at any time.

Continued use of our services constitutes acceptance of the updated Terms.

22. Governing Law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
